The Cultural Heritage Collective

General Terms & Conditions

These Terms and Conditions ("Agreement") govern the relationship between The Cultural Heritage Collective DMC ("we," "us," or "our") and Travel Advisors ("Advisor") submitting reservations on behalf of their clients or travel companies ("Client"). By submitting a reservation request, the Advisor agrees to these terms on behalf of themselves, their company, and their Clients.

1. Booking Process

1.1. Reservation Submission: All booking requests must be submitted via our designated reservation platform, email, or form, with accurate and complete information.

1.2. Advisor Representation: The Advisor warrants that they are authorized to act on behalf of their Clients and have obtained all necessary consents to submit personal and payment information.

1.3. Confirmation: Bookings are confirmed only upon receipt of a deposit or full payment as specified in Section 3 and issuance of a booking confirmation by The Cultural Heritage Collective DMC.

2. Client and Advisor Responsibilities

2.1. Accurate Information: The Advisor is responsible for providing accurate information for all Clients, including names, travel documents, and special requests.

2.2. Travel Documents: Advisors must ensure Clients have valid passports, visas, and other required travel documents for their destination.

2.3. Advisory and Communication: Advisors must communicate all booking details, terms, and itinerary updates to their Clients.

3. Payment Terms

3.1. Deposit Requirements: A non-refundable deposit per traveler is required to secure a booking.

3.2. Final Payment: The balance must be paid no later than 90 days before departure. Failure to make timely payments may result in cancellation.

Ghana in December Trips: Final payments are due no later than May 1st of the same year of the trip. Full payment will be required for secured trips beginning April 17th of the same year of the trip.

3.3. Payment Method: Payments must be made via credit card, Stripe Connect or other methods specified in the invoice.

4. Payments and Commissions

4.1 Payment Submission: The Advisor agrees to adhere to all payment deadlines, including deposits and final payments, as outlined in the booking terms.

4.2 Commission: All rates provided are net and do not include commission. Advisors may add their own mark-up or service fee when quoting Client and will retain the mark-up or service fee received from the Client.

4.3 Non-Payment: Failure to make timely payments may result in cancellation of bookings, and any applicable cancellation fees will be charged.

5. Changes and Cancellations

5.1 Amendments: The Advisor acknowledges that any changes to bookings may incur additional fees or an adjustment in the rate per the number of total guests and/or room occupancy level, which will be communicated and invoiced accordingly.

5.2 Cancellations: The Advisor agrees to communicate all cancellations in writing. Refunds, if any, will be processed according to the cancellation policy outlined in the Terms and Conditions.

6. Liability

6.1. The Cultural Heritage Collective DMC: We act as a coordinator for services provided by third-party suppliers (e.g., airlines, hotels, guides) and are not liable for their actions or omissions.

6.2. Advisor Indemnity: The Advisor agrees to indemnify and hold harmless The Cultural Heritage Collective DMC from claims arising due to errors, omissions, or misrepresentations made by the Advisor.

7. Travel Insurance

7.1. Requirement: Travel insurance is optional for trips that are hosted by the Advisor or private trips. Travel insurance is mandatory for all clients who join a hosted group coordinated by The Cultural Heritage Collective. The Advisor must ensure that Clients purchase comprehensive travel insurance covering trip cancellations, medical expenses, and emergencies no later than the final payment due date.

8. Force Majeure

8.1. We are not liable for failure to perform due to unforeseen events beyond our control, including natural disasters, political instability, or other emergencies.

9. Dispute Resolution

9.1. Governing Law: This Agreement is governed by the laws of Missouri.

9.2. Resolution: Any disputes shall first be resolved through mediation. If unresolved, disputes may proceed to arbitration or court, as applicable.

10. Chargebacks

By booking travel services with The Cultural Heritage Collective, you agree to abide by our payment terms and cancellation policies as outlined in your contract or trip proposal. If you initiate a chargeback or payment dispute with your financial institution without first contacting us to resolve the issue, The Cultural Heritage Collective reserves the right to take the following actions:

10.1 Dispute Submission: We will respond to and dispute any chargeback with documentation, including signed agreements, receipts, communications, and cancellation terms.

10.2 Administrative Fees: A $150 administrative fee will be assessed for any chargeback that is initiated and found to be invalid, in addition to the original amount owed.

10.3 Collection and Legal Action: If a chargeback is filed improperly and results in financial loss to The Cultural Heritage Collective, we reserve the right to pursue recovery through a collection agency or legal means. You may be responsible for all associated costs, including collection fees, attorney’s fees, and court costs.

10.4 Future Bookings: Agents who initiate unfounded chargebacks will be prohibited from booking future trips or services with The Cultural Heritage Collective.

We are committed to providing a high level of service and encourage open communication. If you have questions or concerns regarding any charges, we kindly request that you contact us directly first so we can work with you to resolve the matter promptly and professionally.

11. Amendments to Terms and Conditions

11.1. The Cultural Heritage Collective DMC reserves the right to amend these Terms and Conditions. Advisors will be notified of updates, which will apply to all future bookings.
